Terms and Conditions for Magazine Subscriptions

§1 Scope of These Terms and Conditions

All subscriptions purchased from Heise Zeitschriften Verlag GmbH & Co. KG are subject to the following terms and conditions. Non-standard subscriptions are subject to additional stipulations of which the customer will be informed separately.

§2 Creation of a Subscription Contract

A binding subscription contract is created when the customer receives written confirmation of an order. Subscriptions made by telephone become binding during the respective conversation provided that the vendor accepts the customer’s offer or the customer accepts the vendor’s offer.

§3 Internet Orders

Customers can select a subscription by clicking the appropriate button on the web page found at www.ct-digiphoto.com/subscription. The customer is then required to enter his/her personal order information in the forms that follow. Information can be altered at any time during the order procedure, and the order only becomes binding once the customer makes an offer by clicking the “Order” button.
Customer data entered this way will be forwarded to our Customer Service department for administration and fulfillment of the customer’s order. The contract becomes binding once written confirmation of the order is received by the customer (see §2). The contract language is English.

§4 Parties to the Contract

The customer’s contractual partner is Heise Zeitschriften Verlag GmbH & Co. KG, Karl-Wiechert-Allee 10, 30625 Hannover, Germany, registered at the Amtsgericht Hannover under the roll number HRA 26709. Liability lies with Heise Zeitschriften Verlag Geschäftsführung GmbH, registered at the Amtsgericht Hannover under the roll number HRB 60405. Managing directors are Ansgar Heise and Dr. Alfons Schräder.

§5 Resellers

§6 Delivery Terms

Subscriptions begin with the next issue available following receipt of an order, provided this is at least 15 days before first publication date. Deliveries are made to the address given by the customer. Should delivery problems occur, the customer is to contact the reseller listed under §4 above. Should a renewed delivery be necessary, this will be made immediately.
The customer is to inform the reseller (see §4 above) of any changes in name or delivery address. Non-delivery or loss of paid-for issues that result from untimely notice on the part of the customer are the customer’s responsibility. In this case, the customer has no right of replacement or compensation.

§7 Duration and Cancellation

All subscriptions are for the period of one year (4 issues). If a subscription is not cancelled at least four weeks before expiration, it will be automatically renewed for one year. Cancellations are to be made in writing to Heise Zeitschriften Verlag via the reseller named under §4 above. After renewal, a subscription can be cancelled before delivery of the second issue of the renewed subscription. In case of cancellation before expiry, any excess monies paid in advance by the customer will be refunded.

§8 Terms of Payment

Payment is due in advance for the entire period of the subscription. Subscription prices include delivery in Europe, the USA and Canada. Delivery to all other countries will be charged at cost and, where applicable, local taxes will be added to the invoice total. Payment is to be made either automatically via credit card or within 30 day of ordering to the following account:

Should subscription prices increase, the issue price at the time of introduction of the new price is applicable. The price of issues paid for in advance is guaranteed for the duration of current subscriptions. Price increases will be announced in the masthead of the magazine and in the invoice issued for a subscription renewal. The customer has the right to cancel a subscription within 14 days of receipt of notice of a price rise.

§9 Guarantee

The customer’s statutory rights are unaffected by the contract. The publisher offers no other guarantees.

§10 Privacy

All personal data provided by the customer and required for fulfillment of the customer’s order will be treated according to the stipulations of the publisher’s privacy policy detailed at http://www.heise.de/privacy. Any provision of customer data to third parties takes place according to prevailing civil and criminal law. After cancellation of a subscription, customer data will continue to be stored according to the requirements made by law.

§11 Other Provisions

For cases in which the customer is a trader, a body corporate organized under public law or represents special public assets, the place of jurisdiction and execution is Hannover, Germany. Contracts are subject to the law of the Federal Republic of Germany under exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
